Federal Agents Shoot Man in Marble Hill During Reported ICE Arrest; NYPD Says It Was Not Involved in Shooting

Federal agents shot and wounded a 28-year-old man in Marble Hill on Thursday afternoon, Oct. 8, 2026. amNewYork and News 12 place the neighborhood in the Bronx; legally it is part of Manhattan, attached to the Bronx. As of early Friday morning, Oct. 9, officials say the 5-year-old boy in the man’s car was unharmed. NYPD Commissioner Jessica Tisch said at least one ICE agent fired seven rounds, and NYPD officers were not on the scene when the shots were fired.

What the NYPD says happened

At a late-night news conference, Tisch gave a preliminary account of the shooting, which amNewYork reported occurred shortly after 4 p.m. near 2 Marble Hill Ave. (News 12 placed it near Marble Hill Avenue and West 225th Street.) Federal immigration agents were trying to take a man into custody.

According to Tisch, NYPD surveillance footage showed the man backing a gray Honda CR-V into a parking space near a fire hydrant. One plainclothes federal officer approached the driver’s side window with his gun drawn, while a second approached near the driver’s-side headlight. The vehicle then began moving forward and went out of camera view. Tisch said the cameras did not capture the shooting itself.

“Based on evidence collected at the scene,” amNewYork reported, investigators determined that at least one ICE agent fired seven rounds, striking the driver in the neck, just below his left ear. Police recovered at least seven shell casings, and the vehicle had ballistic damage to its front windshield and a shattered rear window.

Tisch said the NYPD received two 911 calls reporting a shooting near 2 Marble Hill Ave. at 4:04 p.m. A federal agent separately called 911 asking for the fire department before asking for police. Officers from the 50th Precinct Conditions Team, who were responding to an unrelated call nearby, heard reports of shots fired and rushed to the scene.

There, Tisch said, they found several men wearing different types of clothing, including construction-style vests and face masks, with at least one carrying a long gun. The wounded man was handcuffed and seated on the ground. NYPD officers placed him in a police vehicle, gave him medical help and took him to NewYork-Presbyterian Allen Hospital, where he arrived in stable condition. amNewYork had earlier cited unnamed sources for the police transport.

“I want to be clear: the NYPD had no involvement in the federal operation prior to the shooting, and no members of the NYPD were on scene at the time of the shooting,” Tisch said.

She said the boy, believed to be the man’s son, was unharmed and is now in the care of a family member. She also said the man had two prior arrests in New York City, including a 2023 robbery arrest that ended in a guilty plea to fourth-degree grand larceny and five years’ probation, and that a 2025 case of criminal sale of a controlled substance remains pending. Tisch said federal agents had taken control of the investigation.

What DHS says

The Department of Homeland Security (DHS) said in a Thursday night statement, as relayed by amNewYork, that ICE officers were conducting a targeted operation to arrest a Dominican national with a prior grand larceny conviction and multiple previous arrests involving assault, robbery, drugs and weapons. DHS acknowledged that an ICE officer discharged his weapon and that the man was injured. It said officers immediately rendered aid and that the FBI and Homeland Security Investigations were involved in the investigation.

DHS said the man was arrested by the NYPD in December 2023 and released days later, which it blamed on New York’s sanctuary policies. amNewYork noted that the statement did not explain how those policies affected his release. According to amNewYork, DHS released its statement nearly 4 1/2 hours after the incident, and it did not explain what prompted the officer to fire or whether the man was armed. News 12’s version of the DHS history differs slightly: it reported he was convicted of grand larceny and arrested on other drug and weapons-related charges, including by the NYPD in December 2023. These are DHS’s allegations, and they are not independently confirmed here. They also differ in detail from Tisch’s account of two prior arrests.

The FBI told News 12 that its New York Evidence Response team responded to support its partners at DHS.

What the mayor and governor say

Mayor Zohran Mamdani said at the late-night news conference that for two hours he had been on the phone with President Donald Trump and DHS Secretary Markwayne Mullin, negotiating the release of the man. “Those negotiations were unsuccessful,” he said. “Just moments ago, ICE put the man in an unmarked vehicle and whisked him away.” amNewYork reported that it was not immediately clear where federal agents took the man after removing him from the hospital.

Mamdani said agents surrounded the man’s vehicle wearing construction-style vests and masks that concealed their faces. “There is no explanation for federal officers firing this many rounds into a car that has a five-year-old in the car,” he said. He also said, “ICE undermines public safety. It makes us less safe,” and, “This is an agency that must be abolished.” He said he asked Trump and Mullin to have ICE agents leave the scene. News 12 reported that he said the shooting happened right after school let out, when children and families were out and about.

Gov. Kathy Hochul said she spoke with Trump and Mullin on Thursday night. “I expressed outrage on behalf of New Yorkers and urged them to halt ICE enforcement operations in New York,” she said. “I also asked that any body camera footage of the shooting be released to the public so we can establish the facts and get to the truth.” In an earlier statement, she wrote that “New Yorkers deserve to know exactly what happened and why,” and, criticizing ICE for firing a shot with a five-year-old in the car, said, “Any trained law enforcement officer knows how easily that could have ended in tragedy.”

City Council Speaker Julie Menin said in a social media post, “I recognize the immense fear that ICE’s actions have caused immigrant New Yorkers, and I’m deeply worried about the additional anxiety and uncertainty this incident may bring to communities across our city as we await answers.”

U.S. Rep. Adriano Espaillat said he tried to visit the wounded man at the hospital but federal agents would not give him access, amNewYork reported.

Murad Awawdeh, president of the New York Immigration Coalition, an immigrant advocacy group, demanded that ICE reveal the agent’s name publicly and that he be charged and prosecuted if wrongdoing is found. He also said the man should “be released immediately after they recover from ICE custody,” and called for “an independent investigation led by the New York State Attorney General’s Office in collaboration with the NYPD and the District Attorney’s Office.”

Witnesses and protests

Two witnesses spoke to amNewYork, and their accounts are unverified. One said the man screamed, “Don’t let me die,” and that when he was brought to the ambulance, “he just collapsed.” Another said she heard at least three shots and that “No NYPD was there. It was just ICE.”

Residents gathered at the scene. Protesters later gathered outside Allen Hospital, where amNewYork reported that clashes broke out between some demonstrators and the NYPD. News 12 reported that Citizen app video showed people on Marble Hill Avenue, many holding signs that read “ICE OUT.”

amNewYork, citing the Bronx Times, reported that earlier this week elected officials had urged the owners of a nearby shopping mall that includes a Target not to let ICE agents use its parking lot as a staging area. News 12 said lawmakers did so “recently.” No report ties Thursday’s operation to that lot.

What is not known

  • Why the agent fired. DHS did not explain it, according to amNewYork.
  • Whether the man was armed or was the intended target of the operation. DHS describes a targeted operation to arrest a Dominican national.
  • Whether body camera footage exists. The governor asked that any such footage be released.
  • Where the man is being held. The mayor said ICE removed him from the hospital in an unmarked vehicle.
  • The identity and status of the agent who fired.
  • Whether any state or local prosecutor, or any independent body, is investigating. Tisch said federal agents took control of the investigation.
  • What the White House or Secretary Mullin say about the calls the mayor and governor describe. No report gives their account.
